END USER LICENSE AGREEMENT
For the “ATOM Images” Mobile App

1. LICENSE & ACCEPTANCE
ATOM Technologies LLC (“ATOM”) grants you a personal, non-exclusive, non-transferable, revocable license to download, install and use the ATOM Images mobile application (the “App”) on any iOS device that you own or control, strictly in accordance with this EULA. By downloading or using the App, you confirm that you have read, understood, and agree to be bound by all terms herein. If you do not agree, do not download or use the App.

2. ZERO-TOLERANCE POLICY
The App maintains a zero-tolerance policy for:

• Objectionable Content: Any content that is illegal, abusive, harassing, hateful, defamatory, pornographic, terroristic or otherwise objectionable.

• Abusive Behavior: Any use of the App to harass, threaten, stalk, intimidate, defraud or harm individuals or groups.
  Any violation will result in immediate termination of your access and license, without notice or refund.

3. USER ACCOUNTS & SECURITY
You are responsible for all activity under your account. Keep credentials confidential, notify ATOM immediately of unauthorized access, and ensure no one under age 13 uses your account.

4. DATA COLLECTION & PRIVACY
Your use of the App is also governed by ATOM’s Privacy Policy (see https://atomimages.com/privacy-policy). By using the App you consent to ATOM’s collection, use and sharing of data as described there and in Apple’s App Store Data practices.

5. CERTIFICATES & AUTHENTICATION
The App may scan your uploaded content to issue digitally signed “Certificates” of authenticity. ATOM may refuse or revoke any Certificate at its sole discretion.

6. PROHIBITED CONDUCT
You agree not to, directly or indirectly:
a. Reverse-engineer, decompile or tamper with the App or its data.
b. Use bots, scrapers or automated tools to access or extract data.
c. Impersonate any person or forge identifiers.
d. Use the App to develop a competing service.
e. Upload or transmit any material that infringes IP, contains malware, spam, or is illegal, harassing, hateful, sexually explicit, or otherwise objectionable.
Violation may result in suspension or permanent termination of your license.

7. THIRD-PARTY SERVICES & CONTENT
The App may contain links to third-party services. ATOM is not responsible for their terms, privacy policies or practices. Use of any third-party materials is at your own risk.

8. PAYMENT & TAXES
Any in-App purchases are processed via your Apple ID. You authorize Apple to charge your payment method on file. You’re responsible for applicable taxes.

9. WARRANTY DISCLAIMER
THE APP IS PROVIDED “AS-IS” WITHOUT WARRANTY OF ANY KIND. ATOM DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.

10. LIMITATION OF LIABILITY
TO THE MAXIMUM EXTENT PERMITTED BY LAW, ATOM’s LIABILITY IS LIMITED TO THE AMOUNT PAID BY YOU FOR THE APP IN THE 12 MONTHS PRIOR. ATOM IS NOT LIABLE FOR INDIRECT, CONSEQUENTIAL, OR PUNITIVE DAMAGES.

11. TERM & TERMINATION
This license is effective until terminated. You may terminate at any time by deleting the App. ATOM may suspend or end your license if you breach this EULA.

12. GOVERNING LAW & DISPUTE RESOLUTION
This EULA is governed by Texas law and the U.S. Federal Arbitration Act. Any dispute will be resolved by individual, binding arbitration under AAA rules in Austin, TX (no class arbitrations), except you may bring eligible claims in small claims court.

13. APPLE-SPECIFIC TERMS
a. No Apple Party. This EULA is between you and ATOM only—not Apple—and Apple has no obligation under this EULA.
b. Apple Not Responsible. Apple is not responsible for the App, its content, maintenance, support, or warranty claims.
c. Third-Party Beneficiary. Apple is a third-party beneficiary of the section entitled “Scope of License” and may enforce those terms against you.
d. Compliance with App Store Guidelines. You agree to comply with Apple’s App Store Review Guidelines when using the App.

14. GENERAL
This EULA, together with any in-App order forms or policies, constitutes our entire agreement regarding the App. If any provision is found invalid, the remainder remains in full force.
